Terms of Service for ConjuGuru

These Terms of Service ("Terms") govern your access to and use of ConjuGuru ("the App," "we," "us," or "our"), a Japanese conjugation practice application. By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account, downloading, installing, or using ConjuGuru, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Description of Service

ConjuGuru is an educational application designed to help users practice and master Japanese verb and adjective conjugations through audio-based listening drills. The App provides:

• Free Demo Version: Limited access to practice features with restricted content
• Premium Version: Full access to all features, content, voices, and conjugation types through a one-time purchase

3. Account Registration

3.1 Account Creation

• You may use the App anonymously in demo mode
• Premium features require account creation via Google Sign-In
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Eligibility

• You must be at least 13 years of age to create an account
• If you are under 18, you must have parental or guardian consent
• Accounts are for individual use only and may not be shared

3.3 Account Security

• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access

4. Premium Purchase

4.1 One-Time Purchase

• Premium access is offered as a one-time, non-recurring purchase
• Upon successful payment, premium features are activated for your account
• Premium access is perpetual (lifetime) unless terminated as described in these Terms

4.2 Pricing

• Pricing is displayed in the App and may vary by region
• All prices include applicable taxes unless otherwise stated
• We reserve the right to modify pricing with advance notice (existing premium users are not affected)

4.3 Payment Processing

• Payments are processed through third-party payment processors (Stripe or platform app stores)
• You agree to provide accurate payment information
• You authorize us to charge your selected payment method

4.4 No Automatic Renewal

• Premium purchase is a one-time payment with no automatic renewals or subscriptions
• You will not be charged recurring fees

5. Refund Policy

5.1 Refund Eligibility

We offer refunds under the following circumstances:

• Technical Issues: If the App has critical bugs preventing normal use
• Accidental Purchase: Within 48 hours of purchase if you have not extensively used premium features
• Misrepresentation: If premium features materially differ from what was advertised

5.2 Refund Process

• Refund requests must be submitted to support@conjuguru.app within 14 days of purchase
• Include your purchase receipt and detailed explanation
• Refunds are processed to the original payment method within 5-10 business days
• Refund approval is at our sole discretion

5.3 No Refund After Extensive Use

• If you have extensively used premium features (e.g., completed 100+ practice sessions), refunds will not be granted
• Demo mode is provided specifically to evaluate the App before purchase

6. User Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Extract, scrape, or download audio files or data in bulk
• Circumvent or disable premium access restrictions
• Share your premium account with others
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's servers or networks
• Violate any applicable laws or regulations

7. Intellectual Property

7.1 Ownership

• ConjuGuru, including all content, features, code, and audio files, is owned by Ian Eviston
• All rights, title, and interest remain with us
• You are granted a limited, non-exclusive, non-transferable license to use the App

7.2 Audio Content

• Audio files are generated using Microsoft Azure Voice Services
• Audio content is licensed for personal, non-commercial use only
• You may not distribute, sell, or commercially exploit audio files

7.3 Trademarks

• ConjuGuru name, logo, and branding are our trademarks
• You may not use our trademarks without prior written permission

7.4 User Content

• You retain ownership of any practice data generated through your use
• You grant us a license to process and store this data to provide the service

8. Data Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Key points:

• Practice data is stored locally on your device
• Premium users: Account data (email, name) is stored in our secure database
• We do not sell your personal information to third parties

9. Service Availability

9.1 Uptime

• We strive to provide continuous service availability
• We do not guarantee uninterrupted or error-free service
• Scheduled maintenance may require temporary service interruptions

9.2 Audio Downloads

• Audio files are hosted on Cloudflare R2 cloud storage
• Download availability depends on third-party infrastructure
• Offline functionality requires prior audio downloads

9.3 Changes to Service

• We reserve the right to modify, suspend, or discontinue features at any time
• Premium users will be notified of material changes affecting premium features
• Modifications do not entitle you to a refund unless premium features are substantially degraded

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for premium access (currently $9.99)
• This includes damages for loss of data, profits, or business interruption

10.3 Educational Use

• The App is a study tool and does not guarantee language proficiency
• We are not responsible for outcomes of language learning or exam results

11. Indemnification

You agree to indemnify and hold harmless ConjuGuru and Ian Eviston from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your misuse of the App
• Your violation of applicable laws

12. Termination

12.1 Termination by You

• You may stop using the App at any time
• You may request account deletion by contacting us
• Uninstalling the App deletes local data but does not delete your account

12.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or misuse the service
• Fail to pay fees (if applicable in future)

12.3 Effect of Termination

• Upon termination, your license to use the App ends immediately
• Premium access is revoked
• We may delete your account data per our Privacy Policy
• Termination does not entitle you to a refund unless required by law

13. Third-Party Services

The App integrates with third-party services:

• Google Sign-In: Subject to Google's Terms of Service
• Firebase/Firestore: Subject to Google Cloud Terms
• Cloudflare R2: For audio file hosting
• Microsoft Azure: Audio generation (pre-generated, no real-time API calls)

We are not responsible for third-party service availability, changes, or policies.

14. Geographic Restrictions

• The App is available worldwide where permitted by law
• Some features (payment processing) may be restricted in certain countries
• You are responsible for complying with local laws

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing a legal claim, you agree to contact us at support@conjuguru.app to resolve disputes informally.

15.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except:

• Small claims court disputes under $10,000
• Intellectual property disputes

15.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

16. Changes to These Terms

16.1 Modification Rights

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately for non-material changes
• After 30 days' notice for material changes

16.2 Notification

We will notify you of material changes via:

• In-app notification
• Email (if you have an account)
• Update to the "Last Updated" date above

16.3 Acceptance

Continued use of the App after changes constitutes acceptance of modified Terms. If you do not agree, you must stop using the App.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ConjuGuru regarding use of the App.
